This paper discusses, within the context of analytical theory, some of the implications when rape is subsumed within the international crime of genocide and concludes that this type of enquiry is essential for creating a clearer framework to address and understand this violation. From the analysis undertaken, two critical questions become apparent: a) Does compatibility exist when rape is subsumed within the category of a group violation (genocide), if rape is constructed as a violation of an individual’s sexual autonomy? i (...) b) Is the link between rape and genocide necessarily problematic within this notion of autonomy for the individual victim of rape? The process unfolds within an analytical theoretical approach that touches upon the current concept of human rights with its focus on the individual. Although the key element is the individual, the concept of human rights also creates a space, albeit limited and at times controversial, for the group. As such, this paper identifies some of the theoretical implications that emerge once rape is subsumed within the international crime of genocide, which is defined as a violation committed against particular groups. We investigated the contributions of familiarity of setting, self-relevance and self-projection in time to episodic future thinking. The role of familiarity of setting was assessed, in Experiment 1, by comparing episodic future thoughts to autobiographical future events supposed to occur in unfamiliar settings. The role of self-relevance was assessed, in Experiment 2, by comparing episodic future thoughts to future events involving familiar others. The role of self-projection in time was assessed, in both Experiments, by comparing episodic future thoughts to autobiographical (...) events that were not temporal in nature. Results indicated that episodic future thoughts were more clearly represented than autobiographical future events occurring in unfamiliar setting and future events involving familiar others. Our results also revealed that episodic future thoughts were indistinguishable from autobiographical atemporal events with respect to both subjective and objective detail ratings. These results suggest that future and atemporal events are mentally represented in a similar way. (shrink)

Technology has substantially transformed the way legal services operate in many different countries. With a large and complex collection of digitized legal documents, the judiciary system worldwide presents a promising scenario for the development of intelligent tools. In this work, we tackle the challenging task of organizing and summarizing the constantly growing collection of legal documents, uncovering hidden topics, or themes that later can support tasks such as legal case retrieval and legal judgment prediction. Our approach to this problem relies (...) on topic discovery techniques combined with a variety of preprocessing techniques and learning-based vector representations of words, such as Doc2Vec and BERT-like models. The proposed method was validated using four different datasets composed of short and long legal documents in Brazilian Portuguese, from legal decisions to chapters in legal books. Analysis conducted by a team of legal specialists revealed the effectiveness of the proposed approach to uncover unique and relevant topics from large collections of legal documents, serving many purposes, such as giving support to legal case retrieval tools and also providing the team of legal specialists with a tool that can accelerate their work of labeling/tagging legal documents. Lack of understanding about the relationship between federal and state educational institutions brings confusion into discussions of democracy, equity and equality in schools. The 'right to education' continues to be espoused by American society as a birthright, yet it does not figure in federal documentation. This matter has repeatedly come to the attention of legislative courts, who have insisted that the question of education as a fundamental right be addressed. Numerous court cases have attempted to bring closure on this issue, (...) on the basis of such abstractions as national rights, equal access, opportunity and economic disparity among the petitions. However, legal judgments remain inconclusive, reiterating that education remains a state legislative issue. This paper explores the implications of a fundamental right to education through an examination of federal and state legal litigation, discussing the philosophical and ideological roots of discussion of rights and democratic values, and evaluating how federal and judicial participation contributes to overall misunderstanding regarding public schooling. The objective of this paper is to make visible and reflect upon the lives and experience of children from the perspective of alterity, Contesting a traditional gaze that understands childhood from the perspective of lack and negativity. The researchers–a doctoral researcher and an early childhood educator– conducted the study with two groups of children aged between four and six years old, in early childhood educational spaces in two distinct and socially unequal contexts: a group of children living in a favela (...) and a middle/upper class group. Data was produced from observing the interactions of children in play situations, and from individual and collective interviews, photographs and photo exchanges. The researchers sought, through the theoretical lenses of philosophy, sociology, and geography of childhood, to reflect on how children signify their experiences and how they announce new possibilities of relating to school culture. Play is identified as an experience that unites them as a social group, regardless of the unequal conditions in which they live, and through which it is possible to create escape routes, transcend institutional limits, exercise otherness, and produce joyful interaction. Through the ways in which they exercise their relationships with with the world through play, spaces become places and territories of childhood, expressing assigned meanings that interrogate those conventionally instituted by adults; and time is lived by children from the perspective of experience and reiteration, which confronts the chronological, linear time of rigid and standardized routines. Finally, looking at childhood from the perspective of alterity provokes us to think and produce other modes of relationship between adults and children, beyond a colonizing and tutelary perspective, as an opening and reinvention. This contribution addresses some bioethical and medico-legal issues of the opinion formulated by the Italian National Bioethics Committee (CNB) in response to the dilemma between the State’s duty to protect the life and health of the prisoner entrusted to its care and the prisoner’s right to exercise his freedom of expression. The prisoner hunger strike is a form of protest frequently encountered in prison and it is a form of communication but also a language used by the prisoner in order (...) to provoke changes in the prison condition. There are no rules in the prison regulations, nor in the laws governing the legal status of prisoners, that allow the conscious will of the capable and informed subject to be opposed and forced nutrition to be carried out. However, this can in no manner make therapeutic abandonment legitimate: the medical doctor should promote every action to support the patient. In the recent opinion formulated by the CNB it was remarked how self-determination is a central concept in human rights and refers to an individual’s ability to make autonomous and free decisions about his or her life and body. Esta coletânea reúne textos de trabalhos discutidos no Colóquio Construtivismo, realizado em setembro de 2008 no âmbito do Programa de Pós-Graduação de Estudos de Literatura do Departamento de Letras da PUC-Rio. Os artigos reunidos oferecem pistas para outros modos de olhar a literatura através de lentes construtivistas.

Schwartz developed his Theory of Basic Human Values and corresponding instruments, the portrait values questionnaire (PVQ) and the Schwartz values survey (SVS), in order to measure personal values. He uses these instruments (in a slightly modified form) in conjunction with his Theory of Cultural Value Orientations to measure cultural or societal values. His theoretical work is also used in studying organizational values; however, none of these instruments seem suitable to compare personal and perceived organizational values. If the PVQ is widely (...) used to measure personal values, and we need commensurate measures of the person and organization for comparative analysis, then can we not minimally adjust the PVQ to measure organizational values? In this article we discuss the testing of one such adjusted PVQ used for gauging universities’ organizational values. We developed the PVQ-uni to measure university values as perceived by students. We collected data from sociology departments at two universities, one in Austria ( n = 133) and one Nigeria ( n = 156). We then tested the reliability and the validity of the new instrument. Based on the data collected, we found that the PVQ-uni is a reliable and valid instrument; however, further refinements are needed for the instrument to be used successfully in Africa. (shrink)

The rise of the idea of the Anthropocene is promoting multiple reflections on its meaning. As we consider entering this new geological epoch, we realize the pervasiveness of humankind’s deconstruction and reconstruction of the Earth, in both geophysical and discursive terms. As the body of the Earth is marked and reshaped, so is its idea. From a hostile territory to be subjugated and exploited through sovereign commands, the Earth is now reframed as a vulnerable domain in need of protection. The (...) mode of sovereignty, which has accompanied human and legal history and practice during modernity and its project of mastery, is no longer useful. Humanity’s control of the Earth is being reimagined and reconfigured along biopolitical coordinates of thought and action. Biopolitics shifts the focus of power, changes its modalities of interventions, and rearticulates its legitimacy on the idea of taking responsibility for the Earth, for nature. A biopolitical re-orientation of law captures the fundamental aim of caring for nature, of fostering its vital possibilities and of enhancing its productive potential. Yet, biopolitics engulfs nature in its entirety under its framework of control, where protection and subjugation, vulnerability and productivity, life and death are constantly entangled in a reciprocal and inevitable relation of indistinguishability. Sovereignty becomes thus a key modality of biopolitical intervention, when nature is recalcitrant, wild, spontaneous, unpredictable, violent, dangerous. Biopolitics, thus, remains caught in an undecidable dilemma, where in order to protect the Earth, it must subjugate it; to save it, it must condemn it. In this respect, biopolitics remains utterly modern, or as argued by Roberto Esposito, modernity has always been biopolitical, insofar as modernity has emerged as a framework for the protection of life against life’s own excesses. But how can we escape the biopolitical reframing and enframing of the Earth and its total subsumption under its matrix of control? How can we rethink the encounter between law and nature without remaining entangled in the aporetic dilemma of biopolitics? An aesthetics of wonder may offer a way. (shrink)

Aborda a ética no tratamento temático da informação dentro da dinâmica do acesso e uso informacional. Objetiva discutir teoricamente questões éticas em tratamento temático da informação e o impacto dessas sobre a acessibilidade informacional. Metodologicamente, tem-se pesquisa de ordem teórica, exploratório-descritiva e de abordagem qualitativa. Emprega revisão de literatura sobre artigos de periódicos, trabalhos publicados em eventos e capítulos de livro do campo biblioteconômico-informacional. A reflexão teórica evidencia pontos de necessário aperfeiçoamento, a fim de que se garanta um processo representativo (...) imbuído de imparcialidade, limitado à atribuição de assunto que seja concernente ao documento, mas que ao mesmo tempo, não traga perdas para o usuário da informação. Delimita-se, por fim, a necessária integração entre o trato temático, a ética e a acessibilidade informacional, em vias de fomentar a cadeia documental em torno da produção, da organização e do uso da informação. Governments are increasingly inviting patient organizations to participate in healthcare policymaking. By inviting POs that claim to represent patients, representation comes into being. However, little is known about the circumstances under which governments accept POs as patient representatives. Based on the analysis of relevant legislation, this article investigates the criteria that self-help organizations, a special type of PO, must fulfil in order to be accepted as patient representatives by governments in Austria and Germany. Thereby, it aims to contribute to the (...) discussion on the role of governments in steering SHOs. There are different degrees of regulation. Governments in both countries not only formulate explicit criteria for SHOs with respect to patient representation but also guide SHOs representing patients through implicit criteria for associations. We discuss the findings against concepts of responsiveness, authorization, and accountability. Our findings indicate that governmental steering is not negative per se as indicated by previous research but—depending on legislative criteria—can promote transparency and democratic quality in patient representation. En la última década, se han producido fuertes reconfiguraciones en la industria editorial argentina. En principio, se puede pensar en tres procesos que coexisten y que marcan tendencias novedosas en la formación y configuración de los campos editoriales nacionales: la concentración de la industria, la irrupción de las tecnologías digitales y la internacionalización. Los tres procesos se articulan de manera transformadora y complementaria. En este contexto, los editores funcionan como intermediarios culturales a partir del fortalecimiento de emprendimientos de nuevo tipo (...) que hacen usos novedosos de las posibilidades de la digitalización de la palabra. El objetivo de este artículo es exponer la problemática de la edición digital en el campo editorial argentino y cómo las tecnologías de la información y comunicación —TICs—, en el marco del capitalismo informacional, generan nuevos editores y modelos de editorial que proponen modalidades digitales de edición. En particular, hemos analizado la emergencia, en 2007, de Teseo, una editorial argentina, desde una perspectiva cualitativa. Por un lado, el abordaje metodológico se vinculó con el análisis de su página web y su catálogo, y se realizaron además dos entrevistas en profundidad con su director, Octavio Kulesz. A través de la indagación por el sentido en que este editor opera como propulsor de procesos de intermediación cultural, profundizaremos en la dirección de estos nuevos procesos culturales. (shrink)

_Contributions to Law, Philosophy and Ecology: Exploring Re-Embodiments_ is a preliminary contribution to the establishment of re-embodiments as a theoretical strand within legal and ecological theory and philosophy. Re-embodiments are all those contemporary practices and processes that exceed the epistemic horizon of modernity. As such, they offer a plurality of alternative modes of theory and practice that seek to counteract the ecocidal tendencies of the Anthropocene. The collection is comprised of eleven contributions approaching re-embodiments from a multiplicity of fields, including (...) legal theory, eco-philosophy, eco-feminism and anthropology. The contributions are organized in three parts, ‘Beyond Modernity, ‘The Sacred Dimension’ and ‘The Legal Dimension’. The collection is opened by a comprehensive introduction that situates re-embodiments in theoretical context. Whilst closely bound with embodiment and new materialist theory, this book_ _contributes a unique voice that echoes diverse political processes contemporaneous to our times. Written in an elegant and accessible language, the book will appeal to undergraduates, postgraduates and established scholars alike seeking to understand and take re-embodiments further, both politically and theoretically. Several threads of research towards developing artificial gametes are ongoing in a number of research labs worldwide. The development of a technology that could generate gametes in vitro has significant potential for human reproduction, and raises a lot of interest, as evidenced by the frequent and extensive media coverage of research in this area. We have asked researchers involved in work with artificial gametes, ethicists, and representatives of potential user groups, how they envisioned the use of artificial gametes in human (...) reproduction. In the course of three focus groups, the participants commented on the various aspects involved. The two recurring themes were the strength of the claim of becoming a parent genetically, and the importance of responsible communication of science. The participants concurred that (a) the desire or need to have genetic offspring of one’s own does not warrant the investment of research resources into these technologies, and that (b) given the minefield in terms of moral controversy and sensitivity that characterises the issues involved, how information is communicated and handled is of great importance. This memoir consists of two parts, of which the first deals with the foundations of the theory of the struggle for existence, and begins with the introduction of the important concept of quantity of life, besides that of population. The fundamental equations are then established for the case where the individuals of a biological association mutually devour each other, the reasoning being based on the principle of encounters and on the fundamental hypothesis of the existence of equivalents of the individuals (...) constituting the different species which form the association.Having now obtained the equations which determine the rates of change of the numbers of individuals and of the quantities of life of the species, the memoir proceeds to find the equations relating to the stationary state, by establishing theorems which are afterwards applied for the purpose of obtaining the three general laws of the fluctuations. This investigation of the equilibrium state is then followed by the determination of the integrals of the fluctuation equations, and the deduction from these of their most important consequences.The second part of the memoir contains the enumeration and demonstration of the general laws of the struggle for existence, which flow from the discussion of the principles and the integrals obtained in the first part. In this way there is established a new sort of dynamics, demographic dynamics, which, though substantially different from the dynamics of material systems, is developed from an analogous point of view.The second part begins with the principle of the conservation of demographic energy, according to which there are two sorts of energy, one actual and one potential, which transform mutually the one into the other. This principle is the analogue of the principle of conservation of mechanical energy. It is followed by the enunciation of the three laws relating to the biological fluctuations, the experimental verification of which has been investigated by several naturalists. The success which has attended their efforts is well known.Everybody knows the importance ofHamilton's principle in mechanics and in all the domains of physical science. An analogous variation principle can be found in biology, and from it one can deduce the fluctuation equations in the canonical Hamiltonian form and also in the form of a Jacobian partial differential equation. Their integrals in involution from the subject next studied, and in this way are found cases where the integration is reducible to quadratures.Hamilton's principle leads to the principle of least action . There exists also in biology a closely related principle, which may be called the principle of least vital action. Its analytical form is such that it requires the existence of a true minimum, a state of affairs which does not always hold good in the analogous case in mechanics.Die Abhandlung besteht aus zwei Teilen: Der erste ist den Grundlagen der Theorie des Kampfes ums Dasein gewidmet. Man kennt den Erfolg ihrer Bemühungen.Alle Welt kennt die Bedeutung des Prinzips vonHamilton in der Mechanik und in allen Gebieten der Physik. Man kann ein dem Variationskalkül analoges Prinzip in der Biologie finden. Aus ihm kann man die Fluktuationsgleichungen in der kanonischen Form vonHamilton und in der Gestalt einer Gleichung mit partiellen Differentialquotienten vonJacobi herleiten. Ihre Integrale bilden den Gegenstand der folgenden Studien. Man findet Fälle, in denen die Integration sich auf Quadraturen reduziert.Das Prinzip vonHamilton zieht das Prinzip der kleinsten Wirkung oder das Prinzip vonMaupertuis nach sich. Auch in der Biologie gibt es ein mit dem vorgenannten zusammenhängendes Prinzip, welches man das Prinzip der kleinsten vitalen Wirkung nennen kann. Seine analytische Form ist derart, dass es sich um ein wahres Minimum handelt, das im analogen Fall in der Mechanik nicht immer zutrifft. (shrink)

El presente artículo aborda la estrategia escritural de Daniela Catrileo. Se propone revisar la elaboración del concepto de piñen examinando la relación entre lenguaje y colonialidad, para, de ese modo, subrayar el potencial político y reivindicativo que comporta en la novela del mismo nombre, Piñen (2019). Dicha hipótesis articulará el ejercicio de lectura aquí propuesto, atendiendo principalmente las estrategias narrativas empleadas –servirse de un polilingüismo que rompe estructuras gramaticales– para descentrar el lenguaje de su determinismo colonial. Así, interpretamos dicha (...) estrategia escritural en consonancia con las potencias micropolíticas y descolonizadoras del arte descritas por Suely Rolnik y, en consecuencia, apostando por la posibilidad de diagramar un devenir minoritario que dispute los imaginarios del inconsciente colonial-capital. Os fãs de K-pop têm chamado a atenção da mídia internacional por conta de seu engajamento em causas políticas e sociais em diversos países. No intuito de investigar a dimensão política do ativismo desses fãs em específico, este artigo se propõe a abordar o impacto global do K-pop, tendo em vista o debate mais abrangente sobre decolonialidade. Para tanto, utilizamos como objeto de análise o recente caso do fã-clube oficial do BTS, conhecido como ARMY, que desafiou os posicionamentos do presidente (...) norte-americano Donald Trump. A partir de uma abordagem decolonial e da concepção de desobediência epistêmica, apontamos que o consumo da cultura pop sul-coreana dispõe de ferramentas que dialogam com a esfera não-ocidental e funciona fora da lógica colonial, especialmente em meio a ascensão global da boyband BTS. La perception à travers l’imaginationDans le présent travail, je mets en relation les lectures de Wittgensteil et de Gadamer avec les manuscrits de Merleau-Ponty avec l’intention de traverser la construction du « concept de représentation » et de réfléchir sur les questions suivantes : quel lieu occupe la dimension esthétique dans l’expérience humaine? Dans l’expérience esthétique, faut-il retrouver autant le profil émotionnel que le profil cognitif? Le point de départ est que l’esthétique ne doit pas être comprise comme une simple (...) perception par les sens; ce qu’aucun discours sur l’esthétique ne peut occulter est sa nécessaire implication de l’horizon problématique de la perception, à partir de l’étymologie même du terme, dérivé du grec aisthesis.Un tel terme porte en lui autant le champ subjectif instable des sensation que le champ stable et tendanciellement structuré des discriminations perceptives.L’affirmation théorique est que l’expérience de la rencontre d’une oeuvre d’art dévoile un monde et à peine cessons-nous de voir une oeuvre d’art comme objet pour la voir comme un monde que nous nous rendons compte que l’art se révèle être l’expédient pour clarifier le sens de notre rapport perceptif avec le monde, cette syntonie perceptive entre l’essence du monde et le sentir des sujets, cette processualité expressive dans laquelle activité et passivité sont les horizons, qu’on peut certes distinguer dans la description, mais qui coopèrent à l’intérieur d’elle-même.Perception Through ImaginationIn the present work, I bring the lectures of Wittgenstein and Gadamer into contact with the manuscripts of Merleau-Ponty with the intention of going over the construction of the “concept of representation” and of reflecting on the following questions: what place does the aesthetic dimension occupy in human experience? In aesthetic experience, is just as necessary to recognize the emotional profile as the cognitive profile? The point of the departure is that aesthetics must not be understood as a simple perception by the senses. That which no discourse of aesthetics may conceal is its necessary implication of the problematic horizon of perception, following the actual etymology of the term, derived from the Greek aisthēsis.This term contains just as much the subjective and unstable field of sensation as it does the stable field of perceptual discriminations that tend to be structured. The theoretical affirmation is that the experience of the encounter with a work of art unveils a world. No sooner do we stop seeing the work of art as an object and start seeing as a world, then we realize that art reveals itself to be the expedient that clarifies the meaning of our perceptual relationship with the world, this perceptual syntony between the essence of the world and the sensing of subjects, this expressive processuality in which activity and passivity are horizons that can certainly be distinguished in description, but that cooperate internally. Le point de départ est que l’esthétique ne doit pas être comprise comme une simple (...) perception par les sens; ce qu’aucun discours sur l’esthétique ne peut occulter est sa nécessaire implication de l’horizon problématique de la perception, à partir de l’étymologie même du terme, dérivé du grec aisthesis.Un tel terme porte en lui autant le champ subjectif instable des sensation que le champ stable et tendanciellement structuré des discriminations perceptives.L’affirmation théorique est que l’expérience de la rencontre d’une oeuvre d’art dévoile un monde et à peine cessons-nous de voir une oeuvre d’art comme objet pour la voir comme un monde que nous nous rendons compte que l’art se révèle être l’expédient pour clarifier le sens de notre rapport perceptif avec le monde, cette syntonie perceptive entre l’essence du monde et le sentir des sujets, cette processualité expressive dans laquelle activité et passivité sont les horizons, qu’on peut certes distinguer dans la description, mais qui coopèrent à l’intérieur d’elle-même.Perception Through ImaginationIn the present work, I bring the lectures of Wittgenstein and Gadamer into contact with the manuscripts of Merleau-Ponty with the intention of going over the construction of the “concept of representation” and of reflecting on the following questions: what place does the aesthetic dimension occupy in human experience? In aesthetic experience, is just as necessary to recognize the emotional profile as the cognitive profile? The point of the departure is that aesthetics must not be understood as a simple perception by the senses. That which no discourse of aesthetics may conceal is its necessary implication of the problematic horizon of perception, following the actual etymology of the term, derived from the Greek aisthēsis.This term contains just as much the subjective and unstable field of sensation as it does the stable field of perceptual discriminations that tend to be structured. The theoretical affirmation is that the experience of the encounter with a work of art unveils a world. No sooner do we stop seeing the work of art as an object and start seeing as a world, then we realize that art reveals itself to be the expedient that clarifies the meaning of our perceptual relationship with the world, this perceptual syntony between the essence of the world and the sensing of subjects, this expressive processuality in which activity and passivity are horizons that can certainly be distinguished in description, but that cooperate internally. Purpose: To explore the characteristics of the use of laughs and jokes during doctor-couple assisted reproductive technology visits.Methods: 75 videotaped doctor-couple ART visits were analyzed and transcribed in order to: quantify laugh and jokes, describing the contribution of doctors and couples and identifying the timing of appearance; explore the topic of laughs and jokes with qualitative thematic analysis.Results: On average, each visit contained 17.1 utterances of laughs and jokes. Patients contributed for 64.7% of utterances recorded. Doctor and women introduced the (...) majority of laughs and jokes. Visits with female physicians had significantly more laughs and jokes than visits with male doctors; no differences were found considering physicians’ age and years of experience, cause of infertility, and prognosis. Laughs and jokes were mainly recorded during history taking and information giving. Four core themes were identified, regarding the topic of laughs and jokes: health status, infertility treatment, organizational aspects, and doctor-patient interaction.Conclusion: Laughs and jokes are common in doctor-couple ART visits and are frequently used during the dialogue, covering a wide range of topics. Results seem to show that laughs and jokes are related to doctor’s personal characteristics, while are not associated with infertility aspects. Given the complexity of this communicative category, further studies are needed to explore the functions and the effects of laugh and jokes. (shrink)
